By using our Services, you represent and warrant that you meet these eligibility requirements. Prime Hill Capital Group offers pre-settlement funding and other financial services to individuals involved in pending legal actions. The Services we provide are non-recourse, meaning that repayment is contingent upon the successful outcome of your legal case. If you do not recover any funds, you are not required to repay the advance provided.
Application Process
To apply for our Services, you must complete an application and provide all necessary documentation, including information about your legal case. We reserve the right to approve or deny any application at our sole discretion. The approval process may involve consultation with your attorney and an evaluation of your legal claim.
All fees and charges associated with our Services will be disclosed in the funding agreement provided to you. These may include administrative fees, interest, and other charges related to the advance. You agree to review and understand all fees before accepting our Services. The specific amount owed will depend on the terms of the funding agreement and the duration of the funding.
Repayment of the advance, including any applicable fees and interest, is required only if you recover funds from your legal case, either through a settlement or a favorable judgment. The repayment amount will be deducted from the proceeds of your settlement or judgment as specified in your funding agreement.
If you do not win your case or do not recover any funds, you are not obligated to repay the advance. Our Services are non-recourse, meaning that we assume the risk of loss if your legal claim is unsuccessful.
Attorney Involvement
Your attorney must be involved in the pre-settlement funding process. By using our Services, you consent to allow us to communicate with your attorney regarding your legal case and the funding process. Your attorney may be required to sign documents or provide information necessary for the completion of the funding agreement.
Disclaimer of Warranties
Our Services are provided on an “as-is” and “as available” basis. We make no representations or warranties of any kind, express or implied, regarding the operation of our Services or the information provided. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We are committed to protecting your privacy and personal information. Any information you provide to us during the application process or while using our Services will be kept confidential and will only be used in accordance with our Privacy Policy. We may share your information with your attorney or other necessary third parties to facilitate the provision of our Services.
Changes to These Terms
We reserve the right to modify or update these Terms at any time. We will notify you of any changes by posting the new Terms on our website. We recommend you keep a copy of the terms and conditions for your records. Your continued use of our Services after such changes constitutes your acceptance of the revised Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
